1. GENERAL PROVISIONS
1.1. The following text is a contract between the online store obiimy.world, hereinafter “Seller”, and the user of online store services, regardless of the status (natural person, legal entity, natural entrepreneur), hereinafter «Buyer».
1.2. This Agreement defines the terms of sale of scarfs, twillies and other accessories, hereinafter «Goods», Buyer through the Seller’s online store.
1.3. The contract is public in accordance with Art. 633 and Art. 641 of the Civil Code of Ukraine and is equivalent to “an agreement”, and has due legal force.
1.4. In accordance with Art. 642 of the Civil Code of Ukraine by full and unconditional acceptance of the terms of this agreement-offer, which confirms the conclusion of the Agreement on the proposed terms, is the fact that the Buyer pays the value of the goods ordered on the website of the online store (or in another way) goods.
1.5. In this offer, unless the context requires otherwise, the following terms have the following meanings:
“Online store” — Seller’s site, created for the conclusion of Retail and Wholesale Agreements, after the Buyer has acquainted with the Seller’s proposed Goods in photographs remotely.
“Seller” — natural person-entrepreneur Snizhko Svitlana Stepanovna (IPN 3221010084), who sells goods.
“Goods” — products offered for sale and posted on obiimy.world.
“Buyer” — a natural and / or legal person who places an order on the site obiimy.world.
“Recipient” — a natural and / or legal person designated by the Buyer to receive the ordered Goods.
“Accept” — full and unconditional acceptance by the Buyer of the terms of the Agreement.
“Order” — separate items from the range of goods specified by the Buyer when applying on the site.
2. TREATMENT OF THE AGREEMENT
2.1. The Seller sells and delivers the Goods in accordance with the current price list published on the website obiimy.world, and the Buyer pays and accepts the Goods in accordance with the terms of this Agreement.
3. ORDER INFORMATION ORDER
3.1. Order formation.
3.1.1. Orders are accepted through the website obiimy.world during the business hours of the Seller.
3.1.2. The cost of the order includes delivery outside Ukraine to the specified Buyer address with were placing during an order.
3.1.3. Delivery of goods outside Ukraine is not subject to the condition of free delivery of clause of this Agreement. The buyer pays delivery of such goods.
3.1.4. The cost of all types of delivery is stated in the section “Delivery” on the site of the Seller.
3.1.5. However, the Seller does not provide services for the purchase and delivery of goods purchased from third parties at the request of the Buyer.
3.1.6. The order is sent within 24 hours from the moment of its payment by the Buyer.
3.1.7. When placing an order, the Buyer must specify the Recipient’s data as accurately as possible. Incorrect information provided by the buyer may prevent the order from being executed at the specified time. In this case, delivery is postponed until the correct data of the Recipient is clarified.
3.2. Order payment procedure.
3.2.1. Payment of the order means the consent of the Buyer to enter into this Agreement with the Seller.
3.2.2. The buyer pays the value of the order under the Agreement by transferring funds to the settlement account of the Seller using the payment system LiqPay. The date of payment is the day of receipt of funds to the seller’s account.
3.2.3. Prices for any position of the Goods, specified on the site obiimy.world, are valid at the time of ordering.
3.2.4. The buyer has the right to confirm or cancel the order until it is paid.
3.2.5. Orders are accepted to execution only after the receipt of funds to the seller’s account.
3.2.6. The buyer is notified of the payment of the order to the e-mail address that was indicated when placing the order.
3.2.7. Payment systems, terminals and so on The Buyer pays extra.
3.3. Terms of delivery of the order.
3.3.1. Delivery of goods purchased in the online store obiimy.world, in Ukraine is carried out to offices of the Nova Poshta, where orders are issued.
3.3.2. Delivery of goods purchased in the online store obiimy.world, to other countries is carried out by Ukrposhta to the specified address or post office by the buyer.
3.4. Execution of the order on holidays.
3.4.1. Schedule of execution and delivery of orders on holidays is posted on the website obiimy.world in the Delivery section.
4. CREATION OF ORDER
4.1. The Buyer has the right to place an order for the favorite product, posted on the website of the online store obiimy.world.
4.2. Each item can be presented in the order in any quantity.
4.3. In the absence of the goods in the warehouse, the Seller is obliged to notify the Buyer to the notice (by phone, Viber, Telegram, WhatsApp or by e-mail).
4.4. In the absence of goods, the Buyer has the right to replace it with a product of a similar model, to refuse to order this product, to cancel the order.
4.5. The buyer understands and agrees that the original color of the product may be slightly different from the image on the computer screen or any other device because of the individual settings of the device screen.
4.6. The Buyer understands and agrees that the colors of the same products from different batches may differ slightly.
5. REPLACEMENT OF GOODS. RETURN OF GOODS. RETURN OF MONEY.
5.1. If the product is not approached or liked, the buyer has the right to return it within 14 days from the date of the order.
5.2. At the Buyer’s choice, the Seller may replace the goods with another of the same value or return the money.
5.3. Return or replacement is carried out only if the original appearance of the product and packaging is preserved.
5.4. Refunds are made only on the card that was paid for the order.
5.5. The Seller returns the money to the Buyer only after receiving the goods from the Buyer and in case of preservation of its appearance.
5.6. Return of goods is made at the expense of the buyer at the rates of the carrier.
5.7. Before returning, the Buyer sends a return request by phone +38 067 010 85 25 or by e-mail sales@obiimy.world
5.8. After agreeing to the return, the Buyer sends the product to the Seller at the return address by the same carrier to which the goods were received, or in an agreed manner.
5.9. Within 5 working days from the date of receipt of the product by the Seller, provided that its original appearance is preserved, the Seller returns the money on the card that was paid for the order.
6. INTELLECTUAL PROPERTY. COPYRIGHT.
6.1. Due to the presumption of originality of copyright objects, all photographic works are original, therefore protected by copyright without registrations and formalities since their inception in all countries of the world in accordance with the «Bern Convention for the Protection of Literary and Artistic Works» 1886 and the Law of Ukraine «On Copyright and related rights» 1993.
6.2. The subject of exclusive property copyrights to photographic works may authorize the use of these works to third parties and prohibit their use, if any, without obtaining permission. The owner of the photo, posted on the website obiimy.world, gives permission to use his photo only if the photo contains a link to the original source.
6.3. If other authors have found the placement of their photo works on the site obiimy.world all claims are accepted at the e-mail address sale@obiimy.world
7. TERMIN OF THE AGREEMENT ACTION. PROCEDURE FOR INSERTING CHANGE.
7.1. The Buyer confirms the conclusion of the Agreement under the terms of the Offer if consent to payment.
7.2. The Agreement shall enter into force upon payment of the order by the Buyer and shall be valid until the Seller has fulfilled its obligations under this Agreement.
7.3. The Seller has the right to make changes to the text of this Agreement at its discretion at any time and without prior notice to the Buyer. The current (valid) version of the Agreement is always available on the website obiimy.world.
7.4. The Buyer agrees and acknowledges that the amendments to the Offer entail these changes to the already concluded Agreement between the Buyer and the Seller; changes to the Agreement shall enter into force with such changes in the Offer.
8. CONFIDENTIALITY
8.1. The Seller guarantees the secrecy of the information that its Buyer indicates when registering or when placing an order.
8.2. The Seller ensures that personal data will not be used for selfish purposes, on third-party resources or for the distribution of spam.
8.3. When placing an order, the Buyer agrees to the processing of his personal data stored in the Seller’s database solely for the identification of the Buyer / Recipient in repeated orders and for their correct execution. Upon refusal by the Buyer, the Seller will not be able to place an order accordingly.
9. RESPONSIBILITY
9.1. The Seller bears all risks associated with the loss or damage of the goods until it is transferred to the Buyer.
9.2. The recipient or the person who accepted the goods at the time of the Recipient’s absence shall bear all risks associated with the loss or damage to the goods from the moment of its acceptance.
9.3. The recipient or the person who accepted the goods at the time of the Recipient’s absence shall bear all risks associated with the loss or damage to the goods from the moment of its acceptance.
9.4. The Seller is not responsible for improper use or storage of goods by the Buyer, which were ordered on the website obiimy.world.
9.5. The responsibility of the Parties in other cases is determined in accordance with the legislation of Ukraine.
9.6. The parties agree that any controversial situations that have not been resolved through negotiations are resolved in accordance with current Ukrainian legislation.
